TERMS AND CONDITIONS FOR ONLINE PURCHASER REGISTRATION
These terms and conditions are applicable to all persons who wish to purchase a vacant land lot (Lot) at Perch Clyde North in the Stage 1 – Rosella Release.
1. Participation in the Online Purchaser Registration Process (OPRP) is exclusive to persons who have registered their details on the Perch database on or before 11:59pm on Tuesday 13 May, 2025 (Eligible Buyers).
2. All participants in the OPRP (Participants) agree to be bound by the terms and conditions in this document.
3. Registration of Participants opens at 12:00pm AEST on Thursday, 15 May 2025 and closes at 5:00pm AEST on Saturday, 17 May 2025. This is subject to a cap on Participants imposed by the developer, FSPG Communities Pty Ltd (FSPG) at its sole discretion. FSPG reserves its right to close, amend or extend the OPRP registration time at its sole discretion.
4. Prior to the OPRP opening, FSPG will send an email to all Eligible Buyers with details of how to register. FSPG accepts no responsibility for emails sent to an incorrect email address or which do not reach a Participant’s email inbox due to being blocked by, without limitation, a firewall, spam filter or otherwise.
5. In order to progress to the next stage of the OPRP, Participants must fill out all information requested in the OPRP form at registration, which can be accessed via an online link sent to Eligible Buyers only during the time period set out in item 3 above.
6. Purchase appointments will occur commencing from 9:00am on Saturday, 24 May 2025 (Release Date) or such other day as FSPG may nominate. FSPG, in its absolute discretion, will determine the order in which Participants will be allocated purchase appointment times on the Release Date.
7. On Tuesday, 20 May 2025, Participants who have been allocated an appointment time will be contacted by FSPG’s nominated real estate agent, KR Peters Pty Ltd (the Agent). If the Participant does not answer the Agent’s call after 2 attempts, the Participant will lose his or her place in the appointment queue.
8. On Wednesday, 21 May 2025, Participants who have not been allocated an appointment time will be contacted by the Agent. These Participants will be placed on a priority list for appointments, where subsequent appointment times become available or any Lots remain unsold after the Release Date.
9. All successful Participants must pay a holding deposit of $2,000 by electronic funds transfer into the Agent’s nominated trust account in order to have their appointment time confirmed (Initial Holding Deposit). Cheques or cash are not acceptable forms of payment. This Initial Holding Deposit is fully refundable if the Participant decides not to sign a Contract of Sale to purchase a Lot (Contract). If an Initial Holding Deposit is not received by the Agent by 12:00pm on Friday, 23 May 2025, a Participant’s appointment will be cancelled without notice.
10. On the Release Date, the Agent will hold appointments with Participants at the allocated times, either in person at the Perch Sales Office at 2-4 Fenway Boulevard, Clyde North or via electronic means. Appointments will go for a maximum of 15 minutes. If the Participant does not attend or the appointment exceeds 15 minutes, an appointment will be cancelled without notice and any Initial Holding Deposit paid will be refunded.
11. At appointments, Participants will have the opportunity to secure up to one (1) Lot only from the list of Lots available at the time of the appointment, as advised by the Agent, at the price set out on the price list displayed by the Agent.
12. Participants who are allocated a Lot and have paid the Initial Holding Deposit will be sent a Contract by the Agent on the Release Date. Contracts will be via electronic form to the Participant’s nominated email address unless otherwise agreed by FSPG. If the Participant does not sign the Contract by 12:00pm on Friday, 30 May 2025, the Participant’s reservation of a Lot will be cancelled without notice and the Lot will be first offered to Participants who were unsuccessful in securing an appointment time or who were not successful in securing their preferred Lot on the Release Date, at the sole discretion of FSPG. The balance of the deposit, with a deduction for the Initial Holding Deposit, must be paid within 14 days of a Participant signing the Contract.
13. In the event of any disputes or behaviour which FSPG or the Agent regards as dishonest or disrespectful towards FSPG, the Agent or any other Participant, FSPG and/or the Agent on behalf of FSPG reserves the right to cancel a registration appointment and/or any Lot allocation in its absolute discretion.
14. In the event of a disagreement on the Release Date, Lot allocations and reservations are at the sole discretion of FSPG and/or the Agent on behalf of FSPG.
15. FSPG reserves the right to amend or terminate the OPRP in its absolute discretion without notice to Eligible Buyers and Participants.
16. All Participants who participate in the OPRP do so at their own risk. FSPG is not liable to the Participant in any way unless and until a Contract is executed by or on behalf of FSPG, in which case the extent of FSPG’s liability to a Participant is limited to the terms and conditions set out in the Contract with that Participant.
17. The terms and conditions in this document are governed by the laws of the State of Victoria.
